1. Acceptance of terms

By creating an account or using the OneBadge service, you agree to these Terms and Conditions. If you do not agree, do not use the service. These terms form a legally binding agreement between you and ElevareHQ ("we", "us", "our").

If you are using OneBadge on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

2. Description of service

OneBadge provides a SaaS platform that enables web professionals to create, manage, and deploy attribution badges across multiple client websites from a single dashboard. The service includes:

• Badge creation and customisation tools
• A deployable JavaScript snippet for client sites
• Badge health monitoring across registered domains
• Performance analytics including views, clicks, and CTR
• UTM parameter tracking for attribution
• Domain whitelisting and security controls

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

OneBadge is currently in public beta. Features may change, and parts of the service may be added, altered or withdrawn as the product develops. We will give reasonable notice of material changes that affect badges already deployed.

3. Account terms

You must be at least 16 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@onebadge.io if you suspect unauthorised access.

You may not create accounts for the purpose of abuse, spam, or circumventing plan limits. We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable use

You agree not to use OneBadge to:

• Deploy badges on domains you do not own or have authorisation to modify
• Impersonate another person, company, or brand
• Distribute malware, spyware, or any malicious code via the badge script
• Attempt to reverse-engineer, decompile, or extract the source code of the service
• Circumvent any rate limits, access controls, or security measures
• Use the service for any unlawful purpose or in violation of any applicable law
• Resell access to the service without our written permission

5. Payment and billing

Subscription plans

Paid plans are billed monthly or annually in advance. By providing payment details, you authorise us to charge the applicable fees on the billing cycle you have selected.

Lifetime plans

Lifetime plans grant access to the service for as long as OneBadge operates as a commercial product. In the event of service discontinuation, we will provide at least 90 days' notice to lifetime plan holders.

Refunds

Subscriptions are generally non-refundable. Refunds may be granted at our discretion where the payment was made within the last 7 days and the service has seen minimal use, for example where you have not yet created a badge and deployed it to a live domain. Lifetime plans are subject to the same discretionary consideration. To request a refund, contact billing@onebadge.io.

Price changes

We may change subscription prices with 30 days' notice. Price changes will not affect you until your next billing cycle after the notice period.

Cancellation and withdrawal

You may cancel a subscription at any time; access continues until the end of the billing period already paid for. If you are a consumer in the EU or UK you normally have 14 days to withdraw from a purchase of digital services. By starting to use the service within that period you expressly request immediate performance and acknowledge that you lose that right of withdrawal once performance has begun.

6. Intellectual property

OneBadge and all related software, designs, trademarks, and content are the property of ElevareHQ. These terms do not grant you any ownership rights to the service.

You retain full ownership of the badge content you create — the text, logos, and configurations you input into the dashboard. By using the service, you grant us a limited, non-exclusive licence to store and serve that content as necessary to deliver the service.

7. Your client sites and third-party domains

You are solely responsible for ensuring you have the right to install the OneBadge script on any website. We do not verify domain ownership. By adding a domain to OneBadge, you confirm that you have the necessary authorisation.

We are not responsible for any content on client sites or for any consequences arising from the badge appearing (or not appearing) on a client site.

8. Uptime and availability

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance windows will be communicated in advance where possible. We will not be liable for any losses arising from service downtime or unavailability.

9. Limitation of liability

To the maximum extent permitted by applicable law, ElevareHQ shall not be liable for any indirect, incidental, consequential, or punitive damages — including loss of profits, data, or business — arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these terms or the service shall not exceed the total fees you paid to us in the 12 months preceding the claim.

The service is provided on an "as is" and "as available" basis. We do not warrant that it will meet your specific requirements, that it will be uninterrupted, timely, secure or error-free, or that the analytics and monitoring results obtained from it will be accurate or complete.

10. Indemnification

You agree to defend, indemnify, and hold harmless ElevareHQ and its officers, directors, and employees from any claims, damages, or expenses (including legal fees) arising from your use of the service, your violation of these terms, or your infringement of any third-party rights.

11. Termination

You may cancel your account at any time from your dashboard settings. Upon cancellation, your paid access will continue until the end of the current billing period, after which your account will be closed.

We may suspend or terminate your account immediately if you violate these terms, engage in fraudulent activity, or for any other reason at our discretion with or without notice. Upon termination, your access to the service and all associated data will be removed in accordance with our Privacy Policy.

12. Governing law

These terms are governed by the laws of India. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of India. If you are a consumer in the EU or UK, you retain the benefit of any mandatory consumer protection laws in your country of residence.

13. Changes to these terms

We may update these terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the revised terms. If you do not agree to the changes, you may cancel your account before they take effect.
